GENERAL BOOKING TERMS AND CONDITIONS
1. Cancellation of the booking by the guest
The guest may cancel the booking by notifying LoveTenerife in writing using the email address stated in the booking confirmation.
Unless different specific conditions are stated in the offer, rate or accommodation listing, the following cancellation charges will apply:

Cancellation made 14 calendar days or more before the check-in date: free cancellation and a full refund of all amounts paid.

Cancellation made between 13 and 7 calendar days before the check-in date: a cancellation charge equal to 50% of the total booking amount.

Cancellation made less than 7 calendar days before the check-in date: a cancellation charge equal to 100% of the total booking amount.
The cancellation period will be calculated by reference to the check-in date stated in the booking confirmation and the date on which LoveTenerife receives the cancellation request.
Where a refund is due, it will be made using the same payment method used by the guest, unless the parties expressly agree otherwise. Processing times may vary depending on the bank or payment service provider.
Rates expressly identified as non-refundable, as well as promotions or special terms accepted during the booking process, will be governed by their own specific conditions.
2. No-show and early departure
If the guest does not arrive at the accommodation on the scheduled check-in date and has not previously notified LoveTenerife of the cancellation, the booking will be treated as a no-show, and 100% of the total booking amount will be charged.
No refund will be provided where, after the stay has begun, the guest voluntarily decides to:

leave the accommodation before the scheduled check-out date;

not use one or more of the booked nights;
-
not use services included in the booking;
-
reduce the number of guests.
This provision will not apply where the early departure is caused by a breach attributable to LoveTenerife, a serious defect in the accommodation that reasonably prevents its use, or any other circumstance in which a refund is required under applicable law.
3. Right of withdrawal
Under the rules governing distance contracts, the general 14-day right of withdrawal does not apply to accommodation services contracted for a specific date or period.
Once the booking has been confirmed, its cancellation will therefore be subject to the conditions presented during the booking process and to the cancellation policy set out in this document.
4. Changes or inability to provide the booked accommodation
If the booked accommodation cannot be made available due to unforeseen circumstances, force majeure or circumstances beyond LoveTenerife’s reasonable control, LoveTenerife will inform the guest as soon as reasonably possible.
In such cases, LoveTenerife may offer the guest alternative accommodation of a similar or higher category, standard and location, subject to availability and without increasing the originally agreed price.
The guest may choose to:

accept the alternative accommodation offered; or
-
reject it and request a refund of all amounts paid for the services that cannot be provided.
If the alternative accommodation has a lower price, LoveTenerife will refund the corresponding difference to the guest.
Acceptance of equivalent or superior alternative accommodation will not automatically entitle the guest to additional compensation, without prejudice to any rights available under applicable law.
5. Changes requested by the guest
Requests to change the dates, accommodation, number of guests or contracted services are subject to availability and must be expressly accepted by LoveTenerife.
A requested change may result in changes to:

the total price;
-
the cancellation conditions;
-
the minimum length of stay;
-
the contracted services;
-
applicable taxes or charges.
A change will not be regarded as accepted until the guest receives written confirmation from LoveTenerife.
Where the requested change cannot be accommodated and the guest decides to cancel the booking, the cancellation policy applicable to the original booking will apply.
6. Personal data protection
Personal data provided during the enquiry, booking, payment or stay will be processed by:

Personal data will mainly be processed for the following purposes:

managing enquiries and requests;

processing and administering bookings;
-
managing payments, deposits, cancellations and refunds;

providing the contracted accommodation services;
-
communicating with the guest before, during and after the stay;
-
complying with applicable legal, tax, accounting and administrative obligations;

handling complaints, claims and potential liabilities;
-
sending marketing communications where consent has been provided or another lawful basis applies.
The main legal basis for processing is the performance of the contract or taking pre-contractual steps requested by the guest. Certain processing activities may also be based on compliance with legal obligations, the company’s legitimate interests or the guest’s consent.
Personal data may be disclosed, where necessary, to technology providers, booking platforms, payment service providers, banks, property owners or managers, service providers and the competent public authorities.
Guests may exercise their rights of access, rectification, erasure, objection, restriction of processing and data portability by sending a request to info@lovetenerife.cz.
Guests may also lodge a complaint with the Spanish Data Protection Agency if they believe that their personal data has not been processed in accordance with applicable legislation.

7. Acceptance of these conditions
Before confirming the booking, the guest must review and accept these General Booking Terms and Conditions, the accommodation description, the total price, the cancellation policy and any other specific conditions displayed during the booking process.
In the event of a conflict, the specific conditions displayed and accepted for a particular rate or booking will prevail over these General Booking Terms and Conditions in relation to the matters they specifically regulate.
